Terms of Service
These Terms govern your use of Duet — Offline File Transfer ("Duet", "the app", "we", "us"). By downloading, installing, or using Duet, you agree to these Terms. If you do not agree, do not use the app.
1. What Duet is
Duet is a tool for transferring data directly between two devices — over a QR code or a direct connection on your local network. Duet is not a cloud service, backup service, or storage provider: we operate no servers that receive, store, or process the content you transfer, and your transferred content never reaches us. Duet does not guarantee that any transfer will succeed, that data will be delivered, or that it will be retained on either device after a transfer.
2. Licence
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use Duet on devices you own or control, for your personal, non-commercial use. You may not copy, modify, reverse-engineer (except to the extent this restriction is prohibited by law), rent, sell, sublicense, or distribute the app, or remove any proprietary notices.
3. Your content and responsibility
You are solely responsible for the data you choose to send or receive with Duet and for the devices and networks you use. You represent that you have the right to transfer that data and that doing so does not violate any law or any third party's rights. Because transfers are device-to-device and end-to-end encrypted, we cannot see, recover, moderate, or restore anything you transfer.
4. Acceptable use
You agree not to use Duet to transfer, store, or share any content that is unlawful, infringing, malicious (including malware), or that violates the rights or privacy of others; to interfere with or disrupt the app, devices, or networks; or to use the app in any way that breaches applicable law or the terms of the platform you obtained it from.
5. Advertising and third-party services
Duet is free and supported by non-personalized ads served by Google AdMob, and uses consent-gated Google Firebase Analytics and Crashlytics for crash reporting and aggregate usage. These Google services are governed by Google's own terms and privacy policies. Your use of features that rely on them is also subject to those terms. 6. Intellectual property
Duet, its name, logo, design, and software are owned by us and our licensors and are protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.
7. Disclaimer of warranties
Duet is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that any transfer will be successful or complete. To the maximum extent permitted by law, you use Duet at your own risk.
8. Limitation of liability
To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) Duet — even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for gross negligence or for death or personal injury caused by negligence).
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of Duet, the content you transfer, or your breach of these Terms, to the extent permitted by law.
10. Termination
You may stop using Duet at any time by uninstalling it. We may suspend or end your access to the app or any feature at any time, including if you breach these Terms. Sections that by their nature should survive (including sections 3, 6, 7, 8, and 9) survive termination.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms at this URL. Your continued use of Duet after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence provide you greater protection. Nothing here affects your statutory consumer rights.
